All comments received will be given full consideration and a final report discussing our general response as applied to the bulletin’s final version will be released.

The Oregon Division of Financial Regulation (DFR) proposes to issue the attached bulletin regarding Interim guidance for health benefit plans for Section 20 of 2023 Oregon House Bill 2002 (gender-affirming treatment).
Purpose
The purpose of this bulletin is to provide guidance for health benefit plans regarding coverage of gender-affirming treatment under Section 20 of 2023 Oregon House Bill 2002 until final rules implementing HB 2002 are adopted. The Division of Financial Regulation anticipates convening a rules advisory committee to advise on the rules required under HB 2002 in December of 2023. The division expects to adopt final rules implementing HB 2002 prior to January 1, 2025.

The Oregon Division of Financial Regulation (DFR) proposes to issue the attached bulletin regarding expectations for health benefit plans under the Oregon Reproductive Health Equity Act (RHEA).
Purpose
The purpose of this bulletin is to provide guidance on the director's expectations for health benefit plans with respect to RHEA. Topics addressed in the proposed bulletin include:
- The scope of services that must be covered under RHEA;
- RHEA's prohibition on cost sharing;
- Reasonable medical management under RHEA for services other than contraception and abortion;
- Coverage of contraception under RHEA, including therapeutic equivalents and examples of impermissible restrictions;
- Coverage of abortion under RHEA.

The definition of “new prescription drug” for reporting under the Oregon Drug Price Transparency Act
Audience: All manufacturers of prescription drugs sold in Oregon
Purpose:
This bulletin clarifies the definition of “new prescription drug” in OAR 836-200-0505, regarding whether a report is required under OAR 836-200-0520 and ORS 646A.689. The term “original new drug application,” for “specialty drug” reports required under ORS 646A.689, includes both novel drugs and acquired drugs previously approved.

Consumer Disclosure Requirements for Personal Auto Policies with Step-Down Limits
Audience: All Insurers Issuing Personal Lines Auto Policies
Purpose:
The purpose of this bulletin is to provide guidance to auto insurers issuing personal lines auto policies with step-down limits. It outlines disclosures necessary to inform consumers of the nature and extent of coverage. This bulletin repeals No. DFR 2020-19.
Changes were made after hearing the trade associations’ questions and concerns. This revised bulletin provides that the signed acknowledgment must be obtained only at issuance and can be received electronically, that a disclosure document is to be sent to the policyholder at each renewal, and guidance that policy forms should be comprehensible by any reasonable person.

Guidance on Exclusionary Language Regarding Controlled Substances
Summary:
Exclusionary language relating to controlled substances must clearly describe the risks being excluded. Policies containing exclusions for controlled substances must clarify that the legitimate use of prescription drugs is not excluded. Exclusions relating to the use or other activity associated with controlled substances must be limited to losses that are causally related to the described activity.
