Annual price increase reports

The Prescription Drug Price Transparency Act requires prescription drug manufacturers to report on prescription drugs that experienced net yearly price increases of at least 10 percent and had a price of at least $100 for a one-month supply during the previous year. Reports are required to be submitted to the department on July 1, 2019, for the first year of reporting and on March 15 every year after.

Once a drug report has been received, the department will post the name of the manufacturer and the prescription drug that is the subject of the filing to the program website as soon as practicable.

Prescription drug reports will be posted to the department’s website within 90 days after the department received the filing. Any other information requested will be posted within 60 days after receiving the response. All other correspondence or records between the department and the reporting manufacturer will be posted as soon as possible.

Information claimed to be a trade secret in a report filing, other information response, or correspondence will not be posted until a final determination has been made by the department or the director. Any information claimed to be a trade secret determined by the department to be exempt from disclosure will not be directly posted publicly, but will be generally described and include an explanation of the exemption by the department.

Information reported to the department in annual price increase reports will be posted regularly according to the timelines outlined above. The Excel sheet linked above displays information received in the annual price increase reports and information on the outlined reporting requirements as specified in statute, administrative rule, and the program user guide. Data claimed to be a trade secret in a report filing will not be posted until a final determination has been made by the department. The department is actively reviewing and requesting more information about the reports. Information will be updated as soon as possible.
