Reviewing contracts and rates
The Rates and Forms unit reviews and regulates insurance contracts and rate filings. We make sure contracts cover required benefits and are fair to policyholders. We make sure that rates are not inadequate, excessive or unfairly discriminatory.
An interstate compact also reviews certain life insurance, annuities, disability income and long-term care insurance products before they can be sold in Oregon.
Compact policies must meet uniform standards, including strong consumer protections. Insurance companies can file products with the compact representing multiple states or with individual states.
The Division of Financial Regulation is seeking feedback on the attached proposed filing requirement for insurance and annuity advertisements. We understand that new marketing strategies are complex and hope to produce a filing requirement that better addresses the evolving world. If adopted, the new filing requirement would apply to health insurance, life insurance, and annuities.
The proposed filing requirement is meant to address on-going advancements and changes in internet and social media advertising, including the use of algorithms, targeted marketing, and multi-part advertising. If adopted it would be an additional filing requirement in Supporting Documentation in SERFF and will help the division understand a product's marketing campaign holistically rather than through review of individual advertisements. We hope to use this document to reduce review times and increase our confidence that marketing campaigns for insurance products provide appropriate disclosures and information to consumers without being misleading.
