External review clarification (HB 2046) RAC

The Department of Consumer and Business Services (DCBS) is preparing to begin rulemaking on HB 2046 enacted during the 2021 Legislative Session. This rulemaking will solely address Sect. 10 of the bill removing the signed waiver requirement in order for an enrollee to request an external review. Clarifying procedures related to the privacy release form or “authorization form” will reduce administrative barriers for consumers (enrollees) seeking to exercise their right to an objective external review process. Furthermore, clarification will align state rules with federal law.
